Contest rules

CONTEST RULES:

 

LUVO LIFE CO CONTESTS are run by Devonian Coast Wineries Ltd. (the Sponsors). The contest will take place in Canada between March 28, 2022 at 10:00 a.m. Atlantic Time (AT) and May 1, 2022 at 12 p.m. (AT) (the Contest Period). The contest is subject to all applicable federal, provincial, and municipal laws. 

 

For the purposes of the Contest, the “Contest Group” is composed of the Sponsors and their affiliates, including, without limitation, their respective parent and related companies, retailers, franchisees, advertising and promotion agencies, suppliers of material and services, in all cases related only to the Contest, and any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Contest, and its/their respective officers, directors, employees, agents, and other representatives.

 

No purchase necessary. The Contest is open to all legal residents of Nova Scotia who have reached the age of majority (19) as of the date they enter the Contest.

 

Employees of the Contest Group, as well as members of the immediate family (such as their father, mother, brothers, sisters or children) of such employees, their legal or common-law spouses or any persons with whom such employees reside are not eligible to enter the Contest or win a prize.

 

Prize may include but is not limited to: One (1) LS200 4-Person 13-Jet Plug and Play Hot Tub with Multi-Colour Underwater LED Light by Lifesmart Spas, t-shirts, tote bags, sportpacks, and stickers. Total value of all is approximately $4,000 (CAD). 

 

The prize must be accepted as awarded and is not transferable or convertible to cash. No substitutions shall be provided except at the option of Devonian Coast Wineries. Notwithstanding the foregoing, Devonian Coast Wineries reserves the right to substitute a prize or a prize component with one of equal or greater value. Prize will only be awarded to the person whose name and contact information are included in the entry. The Prize will be delivered to the confirmed winner, as applicable, at the address provided by the entrant.

 

In order to be eligible to win and receive the Prize, the selected entrant must have read, understood and agree to the Contest Rules at https://luvolife.ca/contest.html and correctly answer the skill-testing question, without assistance of any kind, whether mechanical, electronic or otherwise, as part of their entry. The selected eligible entrant may be required to swear an affidavit indicating compliance with this requirement.

 

In Halifax, Nova Scotia, one (1) entry from the Contest Period will be randomly drawn from all eligible entries received during the Contest Period.

 

The odds of winning depend on the number of eligible entries received.

 

Acting reasonably, Devonian Coast Wineries will attempt to contact the selected entrant via Instagram direct message. If the selected entrant cannot be contacted within two (2) days of the Draw Date or there is a return of any prior notification as undeliverable, the selected entrant will be disqualified and Devonian Coast Wineries reserves the right to select an alternate entrant from among the remaining eligible entries.

 

In addition to the other requirements described in the Contest Rules, before being declared the winner, the selected entrant will be required to sign and return, within two (2) business days of notification, a Prize Claim Form confirming, inter alia, compliance with the Contest Rules, acceptance of the Prize as awarded and releasing Devonian Coast Wineries, Devonian Coast Wineries’ advertising and promotion agencies, the Contest judges and each of their respective officers, directors, agents, representatives, successors and assigns, from any and all liability in connection with the Contest, the selected entrant’s participation therein and/or the awarding and/or use/misuse of the Prize or any portion thereof. If the selected entrant: (a) failed to correctly answer the skill testing question; or (b) fails to submit the Prize Claim Form within the specified time, then he/she will forfeit the Prize and Devonian Coast Wineries reserves the right to select an alternate entrant from among the remaining eligible entries.

 

The odds of winning depend on the number of valid entries received during the Contest Period.

 

Before being declared a winner (Winner), a selected entrant must, in addition to meeting the Contest eligibility criteria and otherwise complying with the Contest Rules, first be reached by the Sponsor or its representatives within two business (2) days immediately following the selection of the entry;

 

If any condition mentioned above is not met, the selected entrant will be disqualified and shall not be entitled to receive the corresponding prize. The Sponsor reserves the right, in its sole and absolute discretion, to select at random another eligible entrant as a potential prize winner.

 

Following the successful qualification of the winner, the Sponsor or their representatives will send to each Winner an email informing him or her of the method by which he or she may take possession of the awarded prize. Shipped prizes shall not be insured by the Sponsors or the Draw Group who assume no liability or responsibility for lost, damaged or misdirected prizes.

 

The validity of any Contest Entry is subject to verification by the Sponsors. Any illegible, incomplete or fraudulent entries will be disqualified. Any entrant or other individual who enters or attempts to enter the Contest in a manner which is contrary to these official Contest Rules or which is otherwise disruptive to the proper operation of the Contest or by its nature is, in the opinion of the Sponsors, unjust to other entrants or potential entrants will be disqualified. All decisions made by the Sponsors or their representatives, including without limitation those concerning the eligibility or disqualification of entrants, are final and binding without right of appeal. All entries become the property of the Sponsors and none will be returned.

 

All prizes must be accepted as described/awarded. None may be returned, transferred to another individual, substituted for another prize or exchanged in whole or in part for money.

 

The Sponsors reserve the right, in its/their sole and absolute discretion, and for any reason whatsoever, to substitute for any prize, or part thereof, another prize of equivalent or greater value, including without limitation a cash award.

 

By entering the Contest, each entrant acknowledges that the Sponsors shall not be required under any circumstances to award more prizes than the number of available prizes. In the event that, for any reason whatsoever (including without limitation, as a result of an error, malfunction or defect in the design, advertising, management, implementation or administration of the Contest, whether mechanical, electronic, human or otherwise) the number of declared Winners or the number of prizes claimed by entrants is greater than the number of prizes available, the Sponsors reserve the right, in its/their sole and absolute discretion, to end the Contest in whole or in part, without notice, and to award the correct number of prizes among the correct number of Winners, selected in accordance with these Draw Rules from among those eligible entries validly submitted prior to the termination of the Contest.

 

Without limiting the provisions of the Rules above, the Sponsors reserve the right, in its/their sole and absolute discretion, to modify, cancel, terminate or suspend the Contest, in whole or in part, in the event of any cause or circumstance, including without limitation any unauthorized human intervention or any other cause that is beyond the control of the Sponsors, that could corrupt or affect the administration, security, impartiality or normal course of the Contest.

 

By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees: to release, discharge, and forever hold harmless the Contest Group from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant’s participation or attempted participation in the Contest, compliance or non-compliance with these Contest Rules and acceptance and use of the prize. The Contest Group will not be responsible for lost, incomplete, late or misdirected entries during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting death, injury or damage to any person or property arising from, or relating to, that person’s or any other person’s participation or attempted participation in the Contest. Any attempt to undermine the legitimate operation of this Draw is a violation of criminal and civil laws and, should such an attempt be made, the Sponsors reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

 

By entering the Contest, each entrant expressly consents to Devonian Coast Wineries, its agents and/or its representatives, storing, sharing and using personally identifiable information submitted with his/her entry only for the purpose of administering and/or promoting the Contest, unless the entrant otherwise agrees.

 

Each Winner authorizes the Sponsors and its/their advertising and promotional agencies and its/their respective employees or other representatives to broadcast, publish and otherwise use the Winner’s name, photograph, image, statements regarding the Contest or any prize, place of residence and (or) voice for publicity purposes, without any form of remuneration.

 

The personal information gathered about entrants in connection with this Draw will remain property of Devonian Coast Wineries Ltd. and will be used in conjunction with the Privacy Legislation of the Government of Canada at https://www.priv.gc.ca/en/privacy-topics/privacy-laws-in-canada/ . 

 

For the purposes of these Contest Rules, the entrant is the person who is the holder of the email address and/or social media account submitted with an entry. It is to this individual that the prize will be awarded if selected and declared as a Winner.

 

All intellectual property associated with Devonian Coast Wineries and/or the Contest, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, logos, slogans and representations, are owned by Devonian Coast Wineries and/or its affiliates, as the case may be. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
